Re: Kal VaChomer

The fact that kal v'chomer has limitations such as "dayo lavo min hadin l-
hiyot k'nadon", (I love transliterating these things <g>) based simply on
gezeirat hakatuv categorizes it as a middah rather then a sevara, which
would find its limitations in logic alone.

I don't understand why Kal VaChomer is listed as a middah shehaTorah
nidreshes bah, and not considered a form of s'varah.

While Yeridas HaDoros may be an observable phenomenon, it is not a
principle of Judaism, as evidenced by the halacha - at least theoretical -
that a greater Beis Din later in history can overrule a lesser Beis Din's
 earlier enactments.

I assume by greater you mean bchachma ubminyan. Any insights as to how
chachma is measured-does Yeridat Hadorot play a part? What exactly is this
yerida measured by?The concept itself seems very ingrained in at least current
popular Jewish thinking and if it is a principle or even a phenomena which has
continued unchecked throughout Jewish history , are we on an inexorable march,
and to what??

Re: Public Discussions of Arayot

Akiva Miller and others have brought up the dynamic nature of
email discussions as a counterargument to my claim that as a
print medium, this list was a legal medium in which to discuss
arayot. Now that we're going into the details of what email
is, it seems we should make further distinctions. I see your
point on the ephemeral nature of email. However, by the same
token, archived lists such as this one, or newsgroups which are
automatically archived on DejaNews, would *not* be so ephemeral,
and *should* count as permanent print media. Ironically, this
would rule out the ad-hoc arayot list that someone else wanted
to set up - as a list managed by a big CC: list, with no central
archive, it would be ephemeral, and thus fit the "dorshin"
description better. The same would hold for an unarchived email
reflector.

Shabbat shalom, gotta run.

What does popular CURRent thimking mean, the gemar shabbos 112b "if the
early generations are angels then we are mere humans, and if they are
humans we are donkeys...." it would seem that this principle has always
been known. as far RYGB question--I hope to check my sources and verify
the answer that we spoke about today

I used the modifier of "in at least current popular thinking"so as not to get
involved in a debate as to the historical basis of the issue .
